Ownership & Delivery Terms for Monthly Service Plans

By selecting a monthly payment option, the client acknowledges that the plan is offered as a payment convenience for digital services and does not constitute a transfer of ownership until the full service balance has been paid.

During the active service term, Marketify Plus may provide and maintain, depending on the selected plan:

• website design and development
• hosting configuration and hosting service
• domain connection or setup
• technical administration
• related website assets necessary for operation

Until the full project balance has been paid, all website-related deliverables and digital assets developed or configured under the monthly plan shall remain under the ownership and administrative control of Marketify Plus, including where applicable:

• website design and structure
• website files
• hosting configuration
• server environment
• administrative access
• domain connection or managed control
• related digital setup and service infrastructure

The client receives the right to use the website for normal business operations during the active payment term, subject to compliance with the service agreement and these terms.

This right of use does not constitute a transfer of ownership.

Ownership of the website and related transferable assets will only be released when one of the following conditions has been fully satisfied:

1. the client completes all scheduled monthly payments, or
2. the client makes an early full payoff of the remaining service balance

Once the full balance is satisfied, the client becomes eligible to request transfer of the website and applicable digital assets, subject to any separate migration, transfer, or offboarding procedures then in effect.

If the client cancels the monthly service plan, stops making payments, or otherwise fails to complete the agreed payment term before the total balance is paid in full:

• ownership rights will not transfer
• transfer rights will not be granted
• Marketify Plus may suspend, restrict, deactivate, or remove access to the website, hosting, or related services
• Marketify Plus may retain administrative control over all unpaid deliverables and related assets

No release, migration, or transfer obligation shall apply unless the remaining balance is first paid in full and any applicable offboarding or migration fees are satisfied.

Marketify Plus reserves the right to suspend or restrict website access, hosting services, technical support, or related service functions if payments become overdue.

During the payment period, Marketify Plus may keep the website active and operational as a courtesy and business continuity measure, but continued service while payments are overdue is not guaranteed.

Failure to remain current on payments may result in interruption of service until the account is brought back into good standing.

While the monthly plan remains active and payments are made as agreed, the client retains operational use of the website for legitimate business purposes, including:

• online business presence
• customer access
• business functionality
• service-related website operation

Marketify Plus retains service-level and administrative control only to the extent necessary to maintain continuity, security, stability, and delivery of the agreed services.

Clients who select and complete a full upfront payment arrangement are not subject to these monthly ownership restrictions in the same way.

In those cases, ownership is transferred according to the applicable project agreement upon completion of the project and satisfaction of the agreed payment terms.

The client understands and agrees that the Monthly Service Plan:

• is not a loan
• does not accrue interest
• does not create a consumer lending relationship
• is not a financing agreement
• is a structured service arrangement for digital services delivered over time

By choosing the monthly payment option, the client acknowledges and agrees that:

• the website design, domain setup, hosting configuration, and related digital assets remain the property of Marketify Plus until the full balance is paid
• the monthly plan is a payment convenience and not a transfer of ownership
• ownership transfer only occurs after completion of the full payment term or early payoff of the remaining balance
• if service is canceled or payments stop before completion, ownership and transfer rights will not be granted unless the remaining balance is fully paid
• Marketify Plus may suspend or restrict services if payments become overdue

By proceeding with the monthly plan, the client confirms understanding and acceptance of these terms.

Any request for website migration, transfer preparation, administrative handoff, archive preparation, or offboarding support may be subject to separate fees, procedures, and timelines under the applicable Offboarding and Migration Terms published by Marketify Plus.
