1. General
By purchasing or using any hosting, website management, maintenance, support, migration, or related digital service from Marketify Plus, you agree to be bound by these Terms & Conditions.
These terms are designed to ensure a reliable, secure, and fair service environment for all clients. They apply to all hosting packages unless otherwise stated in a separate written agreement, proposal, invoice, or service order.
Marketify Plus reserves the right to interpret and enforce these terms in good faith to protect service quality, business operations, server security, and the interests of its clients.
2. Terms of Service
- Each hosting package is intended for legitimate website and business-related use only.
- Clients are responsible for maintaining accurate billing, contact, and account information.
- Clients must use services in compliance with all applicable local, state, federal, and international laws.
- Clients are responsible for the content hosted under their account, including websites, files, email usage, scripts, and third-party integrations.
- Use of our services does not grant ownership of Marketify Plus infrastructure, software configurations, or proprietary systems unless explicitly stated otherwise in writing.
3. Billing & Payment Terms
- Hosting and related services are billed in advance on a monthly, quarterly, semi-annual, annual, or other agreed billing cycle depending on the plan selected.
- Renewal invoices are due by the invoice due date shown in the client account or billing notice.
- Failure to complete payment on time may result in service suspension, account restriction, or termination.
- Late or overdue accounts may be subject to reactivation fees, restoration fees, or manual administrative charges where applicable.
- Unless otherwise stated in writing, setup fees, labor charges, migration fees, custom work fees, and administrative fees are non-refundable once work has started.
- Domain registrations, renewals, third-party licenses, paid SSL certificates, and other third-party services are generally non-refundable once processed.
- Chargebacks, payment disputes, or unauthorized reversals may result in immediate account review, suspension, and additional administrative recovery actions.
Domain Expiration, Grace Period & Redemption Policy
Domain names are subject to strict expiration timelines enforced by domain registries and registrars. Clients are responsible for ensuring domain renewals are completed before the expiration date shown in their account or billing notice.
- After expiration, a domain may enter a Grace Period of up to 15 days, during which renewal may still be possible subject to an additional late renewal fee.
- During the Grace Period, a Grace Fee of $19.99 may be applied in addition to the standard domain renewal cost.
- If the domain is not renewed during the Grace Period, it may enter a Redemption Period of up to 30 days, during which recovery becomes significantly more expensive and may require manual registrar intervention.
- Domains in Redemption may require a Redemption Recovery Fee of $299.99 in addition to the standard renewal cost.
- Grace and Redemption fees are not simple renewal substitutes. They are additional charges that may apply due to late payment, expiration status, registrar processing, and recovery-related handling.
- Redemption-related costs may be imposed by the registrar, registry, or other third-party providers and are not solely administrative fees created by Marketify Plus.
- Domain recovery is not guaranteed once a domain has entered Redemption. Recovery attempts may fail due to registry status, registrar limitations, domain release timing, auction status, or other third-party restrictions outside the control of Marketify Plus.
- Marketify Plus is not responsible for the loss of domain ownership, interruption of website or email service, or related damages resulting from non-payment, late payment, failed renewal attempts, expired payment methods, ignored notices, or failure by the Client to keep billing and contact information current.
- Clients are solely responsible for monitoring their domain expiration dates, maintaining valid payment methods, reviewing invoice notices, and ensuring timely renewal of all domain services associated with their business.
Marketify Plus reserves the right to apply the applicable Grace or Redemption charges at the time of renewal or recovery request, deny recovery attempts where recovery is not feasible, and adjust recovery handling based on registrar or registry conditions then in effect.
4. Acceptable Use Policy
To protect server stability, security, and service quality, clients may not use Marketify Plus services for unlawful, abusive, or harmful activity.
- Hosting or distributing malware, phishing content, malicious scripts, ransomware, or unauthorized software.
- Sending spam, bulk unsolicited email, or operating abusive mailing behavior.
- Using services for fraud, scams, identity misuse, impersonation, or deceptive practices.
- Hosting illegal content or content that violates copyright, trademark, privacy, or intellectual property laws.
- Operating applications or services that excessively consume CPU, RAM, disk I/O, network traffic, or other system resources in a way that negatively affects other users.
- Using shared hosting for crypto mining, abusive file storage, mass download distribution, or non-website-related storage activity.
- Attempting to bypass security systems, access restricted systems, or interfere with the integrity of the server environment.
5. Storage, Resources & Fair Use
- Storage limits, bandwidth allowances, and plan features are based on the hosting package selected.
- Any “unlimited” feature refers to reasonable use within the intended scope of the service plan and does not remove physical, technical, or performance-based limitations.
- Accounts that place excessive strain on shared infrastructure may be requested to optimize usage, upgrade plans, or reduce resource consumption.
- Marketify Plus reserves the right to suspend, isolate, restrict, or terminate accounts that create instability, performance degradation, or security risk for the server environment.
6. SSL Certificates & Backups
SSL Certificates
- SSL availability depends on the plan, server environment, and certificate type offered.
- Free SSL options, when included, may be subject to automatic renewal conditions, technical compatibility, and provider limitations.
- Paid SSL certificates, additional certificates, or certificate reissues may involve additional charges.
- Marketify Plus is not responsible for third-party certificate authority delays, validation failures, or disruptions outside our control.
Backups
- Backups may be provided as a courtesy feature or as part of a plan, but clients remain responsible for maintaining their own independent backup strategy.
- Marketify Plus does not guarantee the availability, completeness, or restoration success of any backup unless explicitly included as a managed backup service in writing.
- Backup retention periods, restore points, and recovery availability may vary by service plan and server limitations.
7. Privacy Policy
Marketify Plus respects client privacy and is committed to handling personal and business information responsibly. Information collected may include contact details, billing details, technical account data, service usage information, support communications, and website-related operational data.
This information may be used to:
- provide and manage services
- process invoices and payments
- respond to support requests
- improve service quality and account security
- communicate important account, billing, legal, or service notices
Marketify Plus may use trusted third-party platforms such as payment processors, hosting infrastructure providers, analytics tools, domain registrars, and technical service integrations where necessary to operate services.
We do not sell personal information to third parties. However, information may be disclosed where necessary to comply with legal obligations, enforce agreements, investigate fraud or abuse, or protect our rights, systems, and clients.
8. Service Suspension & Termination
Marketify Plus reserves the right to suspend, restrict, or terminate services at its discretion when necessary to protect service quality, enforce these terms, or address security, legal, or billing issues.
- Non-payment, late payment, failed renewals, or unresolved billing disputes.
- Violation of these Terms & Conditions or related service policies.
- Illegal activity, abusive behavior, malware distribution, phishing, spam, or security threats.
- Excessive resource usage or technical activity that disrupts system stability or affects other clients.
- Failure to cooperate in resolving urgent technical, abuse, or compliance-related issues.
9. Limitation of Liability
- Services are provided on a commercially reasonable and best-effort basis unless a separate written SLA explicitly states otherwise.
- Marketify Plus is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, lost business opportunities, or business interruption.
- Marketify Plus is not responsible for downtime, failures, or losses caused by third-party networks, datacenter outages, domain registry issues, software conflicts, cyberattacks, force majeure events, or client-side actions.
- Client assumes responsibility for maintaining copies of critical website content, data, credentials, and business information.
10. Website Ownership & Platform Transfer Policy
Marketify Plus recognizes that certain client-specific digital assets may belong to the Client, depending on the nature of the service and the payment status of any active website development agreement.
Upon cancellation of hosting or related services, the Client may request reasonable access to platforms associated with their business presence, where applicable and where ownership rights permit, including but not limited to:
- Google Analytics
- Google Search Console
- Google Business Profile
- domain management access, when the domain is owned by the Client
Access transfer timing may depend on account verification, outstanding balances, technical limitations, security review, and whether the related website development balance has been fully paid.
11. Website Migration / Offboarding Policy
Website Transfer Package
If the Client chooses to move their website to another hosting provider, Marketify Plus may offer a Website Transfer Package which may include, where applicable:
- website file backup
- database export
- basic restoration guidance or general transfer instructions
This package is intended to facilitate a transition and does not automatically include full migration execution, third-party coordination, redesign work, troubleshooting on the new provider, or advanced server reconfiguration unless separately quoted.
Migration Preparation Fee
Preparation and delivery of website files, exports, access coordination, handoff documentation, or offboarding support may require administrative and technical labor. A one-time migration or offboarding preparation fee may apply.
Optional migration assistance to another provider, including manual coordination, troubleshooting, or partial setup support, may be available for an additional fee.
Third-Party Hosting Responsibility Disclaimer
- Once files, exports, or account access have been delivered, Marketify Plus is not responsible for the receiving provider’s server configuration, software compatibility, performance, restore success, DNS propagation, or uptime.
- Marketify Plus is not responsible for issues caused by outdated plugins, unsupported software, environment mismatches, or third-party hosting restrictions.
- Any additional work requested after initial handoff may require a separate support or consulting fee.
12. Website Development Ownership
Websites, design structures, page layouts, custom development work, configurations, and related deliverables created by Marketify Plus remain the intellectual property of Marketify Plus until all agreed payments for development services have been paid in full.
If a website is provided under a payment plan, monthly ownership model, installment agreement, or subscription-based arrangement, ownership of the website design, structure, and development work will transfer to the Client only after the applicable balance has been fully paid.
If services are canceled before full payment is completed, Marketify Plus reserves the right to:
- suspend access to the website or unpublished project files
- withhold transfer of development ownership rights
- remove proprietary design or development elements not yet fully paid for
- retain control of project deliverables until outstanding balances are settled
Client-owned content provided by the Client, such as logos, copy, licensed photos, business information, or media supplied by the Client, remains the property of the Client.
13. Changes to These Policies
Marketify Plus may update these Terms & Conditions, policies, or service guidelines from time to time to reflect operational, legal, security, or service changes.
Updated versions become effective upon publication on this page unless otherwise stated. Continued use of services after updates constitutes acceptance of the revised terms.
